Sen. Johnson Joins Letter to Biden Administration on Improper Placement of Acting Sec. of Labor Julie Su in Presidential Succession

WASHINGTON – On Wednesday, U.S. Sen. Ron Johnson (R-Wis.) joined U.S. Sen. Katie Britt (R-Ala.) and 28 of their Republican Senate colleagues in sending a letter to President Biden demanding clarification regarding the Biden Administration’s apparent decision to improperly place Acting Secretary of Labor, Julie Su, into the presidential line of succession. The letter calls on the President to withdraw Su’s nomination and put forward a nominee who can garner enough support to be confirmed to the position of Secretary of Labor.

Although Ms. Su has failed to receive Senate confirmation and has bipartisan opposition to her nomination, the Biden Administration is choosing to keep her in place as Acting Secretary of Labor indefinitely and is listing her on the White House website as a member of the Cabinet “in order of succession to the presidency.”

The letter expresses that, pursuant to Article II of the Constitution, Congress has the authority to set the presidential line of succession beyond the Vice President – a power that it exercised with passage of the Presidential Succession Act of 1947. This Act further states that a Cabinet member is eligible to assume the presidency only if they are an officer “appointed, by and with the advice and consent of the Senate.”

Sens. Johnson and Britt are joined in this letter by Senate Minority Leader Mitch McConnell (R-Ky.), Ranking Member of the Senate Committee on Health, Education, Labor, and Pensions Bill Cassidy, M.D. (R-La.), and Senators John Barrasso, M.D. (R-Wyo.), Marsha Blackburn (R-Tenn.), Mike Braun (R-Ind.), Ted Budd (R-N.C.), Shelley Moore Capito (R-W.Va.), Susan Collins (R-Maine), Tom Cotton (R-Ark.), Mike Crapo (R-Idaho.), Joni Ernst (R-Iowa), Deb Fischer (R-Neb.), Lindsey Graham (R-S.C.), Bill Hagerty (R-Tenn.), John Hoeven (R-N.D.), John Kennedy (R-La.), James Lankford (R-Okla.), Mike Lee (R-Utah), Cynthia Lummis (R-Wyo.), Roger Marshall, M.D. (R-Kan.), Markwayne Mullin (R-Okla.), Pete Ricketts (R-Neb.), Jim Risch (R-Idaho.), Tim Scott (R-S.C.), John Thune (R-S.D.), Thom Tillis (R-N.C.), Roger Wicker (R-Miss.), and Todd Young (R-Ind.).
